Klubo taisyklės (Naudojimosi sąlygos):

Įsigydymi bet kurį mūsų Produktą ir Produkto apmokėjimo puslapyje pažymėdami „I have read and agree to the terms and conditions of this page as follows“ varnelę bei atlikdami mokėjimą jūs patvirtinate, jog perskaitėte ir sutinkate su šiomis Produktų įsigijimo ir naudojimosi sąlygomis (toliau – Klubo taisyklėmis). Jūsų patvirtinimas yra prilyginamas sutarties sudarymui. Jeigu jums nėra priimtinos šios Klubo taisyklės, prašome nesinaudoti mūsų Produktais.

1. Naudojamos sąvokos:

Bendrovė – tai įmonė DARIUS LUKAS PTE.LTD, Bendrovė yra savininkas ir Interneto puslapio valdytojas.

Anglų Kalbos Klubas Online  (toliau - AKKO) - Bendrovės įsteigtas internetine veikiantis Klubas - Interneto puslapis, Mokymosi platforma, Facebook Ir Instagram puslapiai bei kitos online erdvės, kurs vykdoma mokymų veikla.

Interneto puslapis – www.anglukalbosklubas.com
Interneto puslapyje jūs turite galimybę susipažinti su Bendrovės vykdoma veikla ir įsigyti jos siūlomus Produktus. Į Interneto puslapį jūs patenkate vienu iš šių būdų:

  • per domeno adresą;
  • per Facebook;
  • per Messenger app;
  • per trumpąja žinutę ar elektroniniu paštu atsiųstą nuorodą;

Interneto puslapis veikia naudojant Kajabi platformą. 

Vartotojas – Bendrovės Produktą/-us įsigijęs bei jais besinaudojantis asmuo.

Produktai – bendrovės ir jos partnerių parengti ir siūlomi anglų (ir kitų kalbų) mokymosi produktai:

  • Klubo narystė (mėnesinė, metinė ar kito pasirinkto tipo narystė Klube, kuri numatytą laikotarpį leidžia naudotis Klubo Mokymosi platforma bei kitais narystės privalumais)
  • Audio, video ir PDF mokomieji produktai (audio ir pdf knygos, video ir audio kursai ir kita AKKO sukurti mokomoji medžiaga)
  • Online kursai su mokytojais (per Zoom ir kitas programėles)

Produkto medžiaga – tai Bendrovės ir jos partnerių parengta metodinė medžiaga, mokymosi platformoje esantys mokymosi audio ir video įrašai, tekstai, o taip pat mokomasis turinys, kuriuo dalinamasi per Facebook, Messenger ar siunčiant elektroniniu paštu.

Produktos apmokėjimo internetinis puslapis - kiekvieno Bendrovės siūlomo Produkto atskiras internetinis puslapis, kuriame nurodytos to produkto įsigijimo ir naudojimo sąlygos.

Mokymosi platforma – aplinka, pasiekiama atitinkamus Produktus įsigijusiam vartotojui per individualią nuorodą ar slaptažodį, kurioje patalpinta Produkto medžiaga, vyksta online susitikimai ir kita mokymosi veikla.

2. Produktų įsigijimas ir duomenų pateikimas:

Aktualūs Bendrovės Produktai, jų kaina ir aprašymai yra pateikiami Interneto puslapyje. Jie gali būti keičiami Bendrovės nuožiūra.

Įsigydamas vieną ar kelis Bendrovės siūlomus Produktus, jūs pateikiate Bendrovei savo asmens duomenis ir sutinkate su jų tvarkymu taip, kaip tai aprašyta Bendrovės Privatumo politikoje.

Prieš įsigyjant bet kurį Produktą jūs turite perskaityti šias Naudojimosi taisykles bei Bendrovės Privatumo politiką, tai – dokumentai, apibrėžiantys jūsų ir Bendrovės teises ir pareigas, asmens duomenų naudojimo tvarką.

Kiekvieno iš Produktų įsigijimo sąlygos yra pateikiamos to Produkto apmokėjimo internetiniame puslapyje.

Įsigydami bet kurį Produktą jūs tampate dvišalės sutarties su Bendrove šalimi, Vartotoju. Jūsų santykiams Naudojimosi taisyklės bei Privatumo politika turi įstatymo galią.

Įsigydami Produktą jūs taip pat sukuriate savo, kaip Vartotojo paskyrą, kurioje pateikiate reikiamus duomenis, susikuriate slaptažodį. Atkreipiame jūsų dėmesį, kad jūs esate pilnai atsakingas už teisingų ir tikrovę atitinkančių duomenų pateikimą bei slaptažodžio paslaptį. Bet kokie veiksmai, įskaitant Produktų įsigijimus, atlikti naudojant jūsų Vartotojo paskyrą ar duomenis bus laikomi atliktais jūsų paties, jums prisiimant pilną atsakomybę už galimas pasekmes.

Atlikus registraciją ir įsigijus Produktą, jūsų nurodytu elektroninio pašto adresu gausite Bendrovės laišką, su detalia informacija apie Produktą ir jo naudojimosi sąlygas. Jums bus pateikta nuoroda individualiam prisijungimui prie Mokymosi platformos. 

Pateikdami savo duomenis įsigyjant vieną ar kelis Bendrovės siūlomus Produktus, jūs sutinkate, kad jūsų nurodytų el.pašto adresu būtų siunčiama Produkto bei susijusi informacija, kaip aprašyta šiose Naudojimosi taisyklėse.

Jeigu nurodėte klaidingą, ne savo, ar nenaudojamą elektroninio pašto adresą, prisiimate atsakomybę už su tuo susijusias Bendrovės klaidas. Pvz., jeigu įsigijus Produktą nurodėte ne savo adresą, informacija apie Produktą jūsų nepasieks, jums nebus suteiktos paslaugos, tretieji asmenys galės pasinaudoti jūsų Vartotojo paskyra ar kils kitos nepageidaujamos pasekmės.

Jeigu suklydote nurodydami savo kontaktinius duomenis taip pat, jeigu pamiršote savo prisijungimo duomenis – nedelsiant kreipkitės į Bendrovę el.paštu [email protected]. Kitais atvejais, jeigu nesinaudojate Produktais, neprisijungiate prie savo paskyros po registracijos Mokymosi platformoje, prisiimate už tai finansinę atsakomybę ir Bendrovei pretenzijų nekelsite.

Kiekviename laiške, jo apačioje, bus nuoroda „Unsubscribe“ (liet. „atsisakyti prenumeratos“), kurią paspaudę jūs atsisakysite komunikacijos elektroniniais laiškais visomis ar pasirinktomis temomis. Atkreipkite dėmesį, kad gaunamos komunikacijos / prenumeratos temas jūs galite pasirinkti Vartotojo paskyroje, nustatymuose. Būkite atidūs – atsisakę visos komunikacijos / prenumeratos, jūs nebegausite ir jums aktualios informacijos, susijusios su visais įsigytais Produktais. Atsisakę visos komunikacijos jūs prisiimate atsakomybę už susijusias nepageidaujamas pasekmes.

Jūs turite teisę bet kada atsisakyti tiesioginės rinkodaros pranešimų, pakeisdami nustatymus savo paskyroje arba pranešdami el.paštu [email protected]. 

3. Apmokėjimas už produktus:

Bendrovės produktų apmokėjimui naudojama Stripe ir Paypal mokėjimų administratorių paslaugos.

Apmokėjimas už Produktus pagal Produktų kategorijas:

3.1 Klubo narystė (mėnesinė, metinė ar kito pasirinkto tipo bei laikotarpio narystė) - tai prenumeratos principu įsigyjama AKKO narystė. Įsigydami Klubo narystę apmokate už ateinantį laikotarpį į priekį, priklausomai nuo narystės tipo - už mėnesinę narystę mokate už ateinantį mėnesį, už metinę narystę mokate už ateinančius metus ir t.t. Toliau narystė yra automatiškai atnaujinama ir apmokėjimas nuskaitomas tokiu pat laikotarpio dažnumu - mėnesinės narystės mokestis nuskaitomas kas mėnesį, metinės - kas metus ir t.t.
3.2 Audio, video ir PDF mokomieji produktai (audio ir pdf knygos, video ir audio kursai ir kita AKKO sukurti mokomoji medžiaga) - už šiuos Bendrovės Produktus Vartotojas sumoka vienkartinę įmoką, nurodytą Produkto įsigijimo sąlygose.

3.3 Online kursai su mokytojais (per Zoom ir kitas programėles) - už šį Produktą Vartotojas sumoka vienkartinę įmoką arba moka dalimis, priklausomai kaip nurodyta Produkto įsigijimo sąlygose.

4. Produktų naudojimo sąlygos, jų nutraukimas ir pinigų grąžinimo politika

Produktų naudojimo sąlygos, jų nutraukimas ir pinigų grąžinimas pagal Produktų kategorijas:

4.1 Klubo narystė (mėnesinė, metinė ar kito pasirinkto tipo ar laikotarpio narystė) - tai prenumeratos principu įsigyjama AKKO narystė, kuri suteikia prieigą numatytą laikotarpį naudotis Klubo Mokymosi platforma bei kitais narystės privalumais. Klubo narystės privalumai priklauso nuo pasirinktos Klubo narystės tipo ir yra pateikiami kiekviename Klubo narystės apmokėjimo puslapyje. Tiek Mokymosi platforma, tiek kitais Klubo narystės privalumais Vartotojas gali naudotis visą apmokėtą laikotarpį. Nutraukus Klubo narystę - prieiga prie Mokymosi platformos, mokymosi medžiagos ir kitų priklausančių Klubo narystės privalumų Vartotojui galioja iki apmokėto laikotarpio pabaigos.

Nutraukti Klubo narystę galite bet kuriuo metu pranešdami apie tai el. paštu [email protected], bet ne vėliau nei likus 1d.d. iki narystės atsinaujinimo dienos. Už apmokėtą laikotarpį pinigai nėra grąžinami ir į kitus Bendrovės Produktus nekeičiami. 

4.2 Audio, video ir PDF mokomieji produktai (audio ir pdf knygos, video ir audio kursai ir kita AKKO sukurti mokomoji medžiaga) - šiuos Bendrovės Produktus įsigijęs Vartotojas gali jais naudotis neribotą laiką, jei Produkto įsigijimo sąlygose nenurodyta kitaip. Už Produktą sumokėti pinigai nėra grąžinami ir į kitus Bendrovės Produktus nekeičiami.
4.3 Online kursai su mokytojais (per Zoom ir kitas programėles) - šį Produktą įsigiję Vartotojai juo naudojasi numatytu laikotarpiu Produkto įsigijimo sąlygose (12 savaičių kursai - 12 savaičių, 6 savaičių kursai - 6 savaites ir t.t.). Už Produktą sumokėti pinigai nėra grąžinami ir į kitus Bendrovės Produktus nekeičiami. Už šį Produktą sumokėta suma ar jos dalis taip pat nėra perkeliama kitam laikotarpiui.

5. Intelektinė nuosavybė

Visas Internetinio puslapio turinys, Produktai ir susijusi Intelektinė nuosavybė išimtinės nuosavybės teise priklauso Bendrovei.

Įsigijus Produktą, su sąlyga, jog laikotės Klubo taisyklių, jums suteikiama neišimtinė ir neperleidžiama licencija naudotis Produkto medžiaga asmeniniais mokymosi tikslais. Produkto įsigijimas, Produkto medžiagos parsisiuntimas į savo kompiuterį, kitos informacijos sužinojimas nesuteikia jums autorių ar kitų teisių į Bendrovės nuosavybę.

Draudžiamas bet koks kitoks, Klubo taisyklių neatitinkantis, Produkto medžiagos naudojimas, kopijavimas, platinimas, perdavimas tretiesiems asmenims, perdirbimas savo reikmėms ar padarymas viešai prieinamais kompiuterių tinklais Internete.

Bendrovės Interneto puslapis, Mokymosi platforma, juose esanti informacija apie Produktus, Produkto medžiaga,  mokymo metodika, paskaitų medžiaga, bet kokia kita su Produkto įsigijimu susijusi ir dėl jos gaunama medžiaga sudaro Bendrovės intelektinę nuosavybę ir know-how, kurie yra ginami įstatymų. Bendrovės teisių ir teisėtų interesų pažeidimas sukelia jums asmeninę bei finansinę atsakomybę už Bendrovės ir jos partnerių nuostolius.

Įsigydami Produktą jūs įsipareigojate naudoti jį tik savo asmeninėms reikmėms. Produktas jokiu būdu negali būti naudojamas savo ar trečiųjų asmenų komercinėms reikmėms, taip pat viešinamas ar kitaip platinamas be išankstinio rašytinio Bendrovės sutikimo. Pažeidę pirmiau nurodytą pareigą, įsipareigojate atlyginti Bendrovei visus su tuo susijusius tiesioginius ir netiesioginius nuostolius.

6. Kitos sąlygos

Bendrovė deda pagrįstas pastangas, kad Interneto puslapyje būtų naujausia informacija, tačiau nesuteikia garantijų dėl jos tikslaus atitikimo mokslinėms metodikoms bei jūsų pasiekiamų individualių rezultatų. 

Bendrovė garantuoja, kad Produktai yra aktualūs ir kokybiški, tačiau, dėl jūsų asmeninių savybių, lygio, gebėjimo mokytis bei įdedamų pastangų kiekio, negarantuoja, kad Produkto įsigijimas sąlygos jūsų įsivaizduojamą rezultatą. Tai yra, jūs neturite teisės reikšti Bendrovei pretenzijų tokiu atveju, kaip, pvz., Produktą įsigijote turėdamas tikslą išlaikyti tam tikros rūšies anglų kalbos testą ar egzaminą, tačiau jo neišlaikėte.

Bendrovė neatsakys už trečiųjų šalių (mokėjimų administratoriaus, svetainės, serverio paslaugų teikėjo, pan.) sukeltas Interneto puslapio veikimo ar Produkto paslaugų teikimo problemas. Tačiau Bendrovė dės visas pastangas, kad dėl tokių sutrikimų prarasti duomenys ar neįvykę online susitikimai būtų atkurti, pakartoti.

Klubo taisyklėms, jų taikymui ir Vartotojų santykiams su Bendrove taikoma Lietuvos Respublikos teisė. Jeigu jūs patenkate į kitos valstybės jurisdikciją ginčai kylantys iš sudarytos mokymosi paslaugų teikimo sutarties sprendžiami pasitelkiant jūsų šalies vartotojų teisių gynimo instituciją, kaip jūsų tarpininką.

The confirmation has the contractual value. If these Conditions of Use are unacceptable for you, you are requested not to use this Website.

Definitions

Company ‒ DARIUS LUKAS PTE.LTD. The Company is the owner and administrator of this Website.

Website ‒ www.anglukalbosklubas.com

User ‒ you and other persons using the Website and the Company’s products.

Products ‒ the English language teaching and related products developed by the Company and its partners and offered on the Website.

Product material ‒ the methodology, audio and video recordings and texts on the Website, as well as other teaching materials that are shared via Facebook Messenger and email developed by the Company and its partners.

Learning platform ‒ online environment, available to user of the products through an individual link or password, which contains the Product material and in which online communications and other teaching/learning activities take place.

Website

The Website is designed for commercial activity of the Company in the field of teaching. The Company not only offers and sells Products but also communicates with you at your contact addresses providing information about the purchased Products and teaching process and possibilities to join school fellows on social networks or elsewhere and encourages learning more about the possibilities to improve you English using Company’s new Products and on your own.

On the Website you become a User and gain a possibility to familiarize with the documents of Company’s activities, procure the offered products and learn with the help of the Products as well as online, to download Product material, communicate with the representatives of the Company and other Users and to learn about the activities of the Company and its partners.

You may access the Website via the:

  • Domain address;
  • Facebook;
  • Messenger app;
  • texted or emailed link.

The website operates using the Kajabi platform. 

For payment for the Products, the payment platform Stripe is used. 

By submitting your personal data on the Website, you agree to receive the Product and related information as described in these Terms of Use that will be send to the email address you provide.

Company’s products and conditions of purchase

The latest Company’s products, their prices and descriptions are given on the Website. They may be changed at the discretion of the Company.

For purchasing one or more Company’s Products you provide the Company with your personal data and acknowledge its management as is described in the Privacy Policy of the Company.

Before purchasing any Product, you shall read the Conditions of Use and Privacy Policy of the Company, which are the documents defining your and Company’s rights and obligations, personal data protection and operation principles of the Website.

By purchasing any Product you enter into a mutual agreement with the Company as a User. The Conditions of Use and the Privacy Policy have the power of laws to your relations with the Company. 

By purchasing a Product you also create your User’s account in which you provide the necessary data and create a password. We bring to your notice that you accept full responsibility for provision of valid data and password security. Any actions, including Product purchases, taken using your User’s account or personal data shall be regarded as taken by You personally in full responsibility for the possible consequences.

By purchasing a Product you join the English Language Club acquiring a long-term paid membership. The duration and conditions of membership are defined in the description of the Product and can be changed or membership can be cancelled under the Conditions of Use.

After registration and purchase of Product, you will receive an e-mail from the Company containing detailed information about the membership and its conditions. You will be supplied with a link for individual access to the Learning platform.

If you provide invalid, stranger or out-of-use e-mail address you shall bare responsibility for the related mistakes of the Company. For example, if purchasing the Product you provide an address of some other person, the information about the Product will not reach you, you will have no access to the services, third parties may use your account or you will have to cope with other undesirable circumstances.

If you have mistaken providing your personal data, as well as in case you have lost or forgotten the account data or password, please immediately approach the Company via email [email protected]. Otherwise you will be financially responsible for non-usage of the Products and or your account at the Website or Learning platform, and shall file no related claims to the Company.

Every e-mail will have a link “Unsubscribe” at the bottom by clicking which you will reject communication via e-mail on all or chosen subjects. Take notice that the subjects of communication/subscription can be chosen on your User’s account. Be attentive because after rejection of all communication/subscription you will be no longer receiving the material about the purchased Product, any invitations to teaching sessions on the Learning platform and other related materials. Rejecting communication in full you will take responsibility for related undesirable consequences.

You have the right to refuse from direct marketing communication of the Company by changing the settings of your account or by e-mailing to [email protected].

Prices, termination and renewal of the membership, refund policy

The Company upholds strict refund policy due to the pricing structure: the price of the purchased Product depends on the duration of membership and is established based on the Company’s investments and expenditures. The payments for the Products are not refunded, with exceptions given in this section.

Confirming the Conditions of Use you acknowledge your understanding that both payment administration costs and costs of possible payment return through interbank transfer comprise minimal losses of the Company suffered as a result of early contract termination requested by you.

By starting the use of the Product you receive access to all Product material (for the whole period) provided by the Company in advance expecting no early termination of your membership.

Product with monthly membership: monthly subscription fee is applied, which is charged from your bank account every month on the same day of membership acquisition and the first payment. The monthly membership fees are given in the description of the Product.

Product with yearly membership: yearly subscription fee is applied, which is charged from your bank account every year on the same day of membership acquisition and the first payment. The yearly membership fees are given in the description of the Product.

Product with free trial period: the Product is provided for free for the first month (31 calendar days). Starting with the 32nd day, the conditions for Product with one month membership are applied.

Present User’s are proposed with an intensive course Product: it is the product of a fixed duration, which is regarded as a complementary membership product with fixed price and paid for in one instalment before the beginning of the use of the Product. On client’s request, the parties may agree on partial payments.

In order to provide a long-term quality teaching service, the Company automatically renews monthly and yearly membership Products on the expiry date. The renewal is made for the same time period as the first subscription term (e.g. one-month membership is resumed every month, three-months membership is resumed for three months, etc.) If you do not want to renew the membership, you should inform the Company before the membership expiry date to the following address: [email protected].

If you want to terminate the membership or to cancel any separate product please send us informative message to the following address: [email protected].

The payment for the Product will be refunded only in case you have paid in advance for supplementary Product validity times, i.e. in case of monthly membership Product the payment will be returned for the months following the current month; in case of yearly membership Product it will be returned for the year following the current year.

After the monthly or yearly Product is cancelled you shall maintain the Product access for the paid period.

For other than monthly or yearly membership Products the refund procedure is applied based on individual agreement of the User and the Company. This applies with the condition that the User haven’t started using the Product. The refunded amount shall be reduced with amounts covering the minimal losses suffered by the Company due to the early termination of the contract.

Intellectual property

The whole content of the Website, the Products and related intellectual property belong to the Company by exclusive property right.

On purchase of the Product, provided that you follow the Conditions of Use, you are granted a limited term, non-exclusive and non-transferable license to use the Product material for personal learning purposes. Acquisition of the Product, downloading of the Product material and access to other information do not grant you copyright or other rights to Company‘s property.

No part of Product material and Company’s intellectual property may be used for other purposes than indicated herein: it is forbidden to otherwise use, copy, disseminate or transferred to third parties, remake for personal purposes or make it publicly available by electronic means on the internet.

The Website of the Company, Learning platform and contained information about the Products, Product material, teaching methods, lecture material and any other material related with Product purchase and membership are intellectual property and know-how of the Company and are protected by the laws. Infringements of the Company’s rights and legal interests shall cause your legal and financial liability for the losses of the Company and its partners.

By purchasing a Product you take on the non-competition obligation: you shall not compete with the Company using the intellectual property and know-how of the Company for personal or third parties’ commercial purposes. The fine for a breach of the non-competition obligation shall be equal of all amounts for which the Company sold you the Products. The Company shall have the right to reserve this sum in your bank account for its benefit and receive it in case of impossibility to eliminate fully the breach. The fine payment shall not relieve you from obligation to cover the Company’s losses excessing the fine amount, if any and reported to you by the Company in writing.

Other conditions

The Company puts reasonable efforts to provide the Website with the updated information but does not guarantee as to its precision in regards to respective academic works or to your personal results.

The Company guarantees that the Products are relevant and of good quality yet, in view of your individual features, level of knowledge, ability to learn and efforts, cannot guarantee that the purchase of the Product necessarily will bring the results the way you expect it. I.e. you have no right to file a claim to the Company for purchasing the Product in order to pass some English test in which you failed.

The Company is not liable for the problems of Website operation or service provision (payment administration, website, server services provider) caused by the third parties. However, the Company will do its best to reproduce the data or repeat the online communications lost due to the mentioned problems.

The Conditions of Use and their application as well as communications between the Company and the User are governed by the laws of the Republic of Lithuania. If you belong to the jurisdiction of other country, the dispute between the User and the Company related with the teaching/learning contract is resolved by invoking the consumer protection institution of your country as an intermediary.
